1. About These Terms
This website is operated by Trundles Automotive Limited ("Trundles Automotive", "we", "us" or "our").
These Website Terms of Service ("Terms") apply when you access or use our website or purchase products or services from us through our website.
By placing an order with us, you agree to these Terms and the applicable policies linked above.
If you purchase from us through an approved trade, reseller or credit account, our separate Terms of Trade may also apply.
2. Using Our Website
You must use our website only for lawful purposes.
You must not:
- interfere with the operation, functionality or security of the website;
- attempt to gain unauthorised access to our systems or accounts;
- upload malware or other harmful material;
- use automated systems to scrape or collect website information without our permission;
- provide deliberately false or misleading information;
- infringe our intellectual property or another person's rights;
- collect personal information about others unlawfully; or
- use the website for fraudulent, unlawful or abusive purposes.
We may restrict or suspend website access where reasonably necessary to protect our customers, staff, systems or business.
3. Website Accounts and Trade Access
If you create or are provided with a website account, you are responsible for keeping your login details secure.
You must:
- keep passwords and login details confidential;
- not allow unauthorised persons to use your account; and
- notify us if you become aware of unauthorised access or use.
We may suspend or restrict an account where reasonably necessary for security, fraud prevention, account management or compliance purposes.
Trade and Reseller Access
Access to trade pricing, reseller pricing, trade website functionality or credit facilities is subject to approval by Trundles Automotive.
Trade, reseller and credit accounts remain subject to ongoing review.
Each business will generally be provided with one trade website login unless we approve otherwise.
Approved trade, reseller and credit customers are also subject to our separate Terms of Trade.
4. Product Information and Fitment
We take reasonable care to ensure product descriptions, specifications, photographs, pricing, stock information and vehicle applications are accurate.
However, errors, supplier changes and manufacturer updates may occasionally occur.
Product photographs are illustrative. Packaging, labelling, colour, finish or minor cosmetic details may change where this does not materially change the identity, specification, quality or intended use of the product.
Vehicle Fitment
Vehicle fitment can depend on factors including:
- make and model;
- year;
- engine;
- transmission;
- body or chassis configuration;
- factory options;
- existing modifications; and
- other components fitted to the vehicle.
If you ask us for fitment advice, you are responsible for providing accurate and complete vehicle information.
Where a vehicle has been modified, or compatibility cannot be confirmed from the information available, we may require further information or technical confirmation before recommending or supplying a product.
Some products may require professional installation, modification, certification or compliance checks. It is the customer's responsibility to ensure any required installation or certification is carried out appropriately.
5. Pricing and GST
Unless otherwise stated, website prices are displayed in New Zealand dollars (NZD).
Prices for New Zealand customers include GST.
International orders may be supplied excluding New Zealand GST and may be subject to import duties, taxes, customs charges or other fees in the destination country. Unless otherwise stated, these charges are the customer's responsibility.
We may change website pricing at any time for future orders.
A pricing change will not alter the agreed price of an order we have already accepted unless we contact you and you agree otherwise.
6. Placing an Order
Submitting an order through our website is an offer to purchase the selected products.
An automated order confirmation means we have received your order. We may still need to check matters including:
- stock availability;
- pricing;
- payment;
- product or vehicle compatibility;
- suspected fraud; or
- an obvious error in the order.
We may decline or cancel an order before fulfilment where there is a genuine pricing error, supply issue, stock error, suspected fraud, legal restriction or another reasonable reason why we cannot supply the order.
If we cancel an order after receiving payment, we will refund the amount paid for the affected item unless another option is agreed with you.
7. Product Availability, Pre-Orders and Backorders
All products are subject to availability.
Stock information may change due to incoming stock, customer orders, supplier availability and normal stock turnover.
Some products may be listed as:
- pre-order;
- backorder;
- supplier stock;
- special order; or
- subject to an estimated lead time.
Supplier and manufacturer lead times are estimates and may change for reasons outside our control.
If an item becomes unavailable or significantly delayed after you place an order, we will contact you where necessary to discuss the available options.
These may include:
- continuing with a backorder;
- changing to an agreed alternative product;
- store credit; or
- a refund where appropriate.
8. Product Substitutions
We will not substitute an advertised brand with another brand, or supply a materially different product, without contacting you first and obtaining your agreement.
If an agreed alternative costs more than the product originally ordered, we will explain the price difference and obtain your approval before proceeding.
Changes to packaging, labelling or other minor manufacturer presentation that do not materially alter the ordered product are not considered a product substitution.
9. Payment
Unless we agree otherwise, orders must be paid in full before dispatch or collection.
Where payment is pending through bank transfer, invoice, manual payment method or finance approval, stock may only be held for a limited period.
Unless otherwise agreed in writing:
- unpaid orders may be cancelled after 3 business days;
- allocated stock may be released; and
- availability may change before payment is received.
Special-order, indent, custom-made or specially procured products may require payment before we place the order with our supplier or begin manufacture.
10. Partial Fulfilment
If part of an order is available and another item is on pre-order or backorder, we may dispatch the available products separately.
Where reasonably possible, we will provide an estimated timeframe for the remaining products.
If an outstanding item becomes unavailable or significantly delayed, we will contact you to discuss the available options.
11. Order Cancellations
Customer-requested cancellations are subject to our Refunds & Returns Policy.
Whether an order can be cancelled may depend on whether it has already been:
- processed;
- picked or packed;
- ordered from a supplier;
- specially procured;
- manufactured or modified;
- allocated specifically to the customer; or
- dispatched.
Special-order, indent, custom-made or modified products may have additional cancellation restrictions.
Nothing in this section limits rights that cannot legally be excluded.
12. Shipping and Delivery
Shipping, freight, delivery timeframes, collection, damaged parcels, lost parcels and international shipping are covered by our Shipping Policy.
Delivery dates and timeframes are estimates unless we expressly agree otherwise.
Delays may occur because of courier networks, suppliers, weather, customs, rural delivery or other circumstances outside our reasonable control.
13. Returns, Exchanges and Refunds
Change-of-mind returns, incorrect purchases, exchanges, cancellations and other non-fault returns are handled in accordance with our Refunds & Returns Policy.
Different rights may apply where goods are faulty, damaged, incorrectly supplied or fail to meet a guarantee required by law.
Nothing in our Refunds & Returns Policy or these Terms limits rights that cannot legally be excluded.
14. Warranty and Faulty Products
Warranty claims are handled in accordance with our Warranty Policy.
We may require information reasonably necessary to assess a warranty or product claim, including:
- proof of purchase;
- photographs or videos;
- product identification or part numbers;
- vehicle details;
- installation information;
- information about modifications;
- details of the alleged fault; and
- inspection or testing of the product.
Submitting a warranty claim does not mean that the claim has automatically been accepted.
We will assess the claim before confirming the available remedy.
Nothing in our Warranty Policy or these Terms limits rights that cannot legally be excluded.
15. Consumer Rights
If you acquire goods or services from us as a consumer, you may have rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986, and other applicable New Zealand law.
Nothing in these Terms, or in our Shipping, Refunds & Returns or Warranty policies, excludes, restricts or modifies a right or remedy where it would be unlawful to do so.
Our change-of-mind returns policy and any manufacturer's or Trundles Automotive warranty are additional to any rights you may have under applicable consumer law.
16. Trade, Reseller and Business Customers
If you purchase products for business purposes or through an approved trade, reseller or credit account, our separate Terms of Trade may apply in addition to these Terms.
The Terms of Trade cover commercial matters including:
- trade and reseller pricing;
- credit facilities;
- payment terms;
- account reviews;
- retention of title;
- security interests and PPSR registration;
- overdue accounts and debt recovery;
- personal guarantees where applicable;
- commercial warranties; and
- business-to-business liability provisions.
Any contracting out of the Consumer Guarantees Act for a business transaction will only apply where the legal requirements for doing so have been met.
17. Intellectual Property
Unless otherwise stated, the content of this website is owned by or licensed to Trundles Automotive.
This includes:
- text;
- photographs;
- graphics;
- product information;
- documents;
- drawings;
- logos;
- branding; and
- other website materials.
You may not reproduce, publish, distribute, modify or commercially exploit our website content without our prior written permission, except where permitted by law.
18. Reviews, Comments and Customer Content
If you provide a review, photograph, comment, testimonial or other content to us for publication, you confirm that:
- you have the right to provide it;
- it is not deliberately false or misleading;
- it does not unlawfully infringe another person's rights; and
- it is not unlawful, threatening or abusive.
Where you provide content to us for publication, you give Trundles Automotive a non-exclusive, royalty-free licence to use, reproduce and display that content for reasonable business and promotional purposes.
We may moderate, edit or remove customer content where reasonably necessary.

Our Privacy Policy explains how we handle personal information relating to orders, accounts, customer enquiries, warranties, trade accounts and use of our website.

We make reasonable efforts to keep our website available, secure and accurate.
However, we cannot guarantee that the website will always be uninterrupted or error-free.

- perform website maintenance;
- update or change functionality;
- correct genuine errors or omissions;
- restrict access where reasonably necessary; or
- discontinue website features.
If an error in pricing, availability or product information affects an order you have already placed, we will contact you where necessary to explain the issue and the available options.

Nothing in these Terms excludes or limits any liability, right or remedy that cannot legally be excluded or limited.
To the extent permitted by law, Trundles Automotive is not responsible for indirect or consequential loss arising solely from the operation, interruption or unavailability of the website.
Liability relating to products, services, delivery, returns and warranties remains subject to applicable law and the relevant policies forming part of these Terms.
23. How These Terms Work With Our Other Policies
These Terms should be read together with our:

- Shipping Policy;
- Refunds & Returns Policy; and
- Warranty Policy.
Where a specific policy deals with a particular issue in more detail, that policy applies to that issue, subject always to applicable law.
Approved trade, reseller and credit customers may also be subject to our separate Terms of Trade.
If there is a conflict between these Terms and the Terms of Trade in relation to an approved business account transaction, the Terms of Trade will apply to that business transaction to the extent permitted by law.
24. Changes to These Terms
We may update these Terms from time to time to reflect changes to our website, products, services, business practices or legal requirements.
The current version will be published on our website with the date of the latest update.
Changes apply to future website use and orders after publication.
Unless required or permitted by law, an update to these Terms will not retrospectively change an order we have already accepted without your agreement.
25. Governing Law
These Terms are governed by the laws of New Zealand.
Any dispute is subject to the jurisdiction of the New Zealand courts, subject to any rights or remedies that apply under New Zealand law.
